{"id":15560,"date":"2023-03-02T13:11:47","date_gmt":"2023-03-02T19:11:47","guid":{"rendered":"https:\/\/mexpatrealtors.com\/?p=15560"},"modified":"2023-03-08T20:48:17","modified_gmt":"2023-03-09T02:48:17","slug":"how-profeco-regulates-timeshare","status":"publish","type":"post","link":"http:\/\/mexpatrealtors.com\/fr\/how-profeco-regulates-timeshare\/","title":{"rendered":"How Profeco Regulates Timeshare?"},"content":{"rendered":"<p class=\"has-text-align-left\">La Procuraduria Federal del Consumidor contr\u00f4le les activit\u00e9s des fournisseurs et des interm\u00e9diaires qui proposent aux consommateurs des services de multipropri\u00e9t\u00e9 en temps partag\u00e9, afin de s'assurer qu'ils agissent conform\u00e9ment aux lois applicables et que les droits des consommateurs ne sont pas viol\u00e9s. \u00c0 cet effet, l'article 65 de la loi f\u00e9d\u00e9rale sur la protection des consommateurs dispose que la vente ou la pr\u00e9vente d'un service de multipropri\u00e9t\u00e9 en temps partag\u00e9 ne peut avoir lieu que lorsque le contrat d'adh\u00e9sion est enregistr\u00e9 aupr\u00e8s de PROFECO et qu'il doit contenir les exigences susmentionn\u00e9es, ainsi que celles \u00e9tablies dans la norme officielle mexicaine NOM-029-SCFI-2010.<\/p>\n\n\n\n<figure class=\"wp-block-image aligncenter size-full\"><img fetchpriority=\"high\" decoding=\"async\" width=\"298\" height=\"297\" src=\"https:\/\/mexpatrealtors.com\/wp-content\/uploads\/2023\/03\/postt.jpg\" alt=\"\" class=\"wp-image-15561\" srcset=\"https:\/\/mexpatrealtors.com\/wp-content\/uploads\/2023\/03\/postt.jpg 298w, https:\/\/mexpatrealtors.com\/wp-content\/uploads\/2023\/03\/postt-150x150.jpg 150w\" sizes=\"(max-width: 298px) 100vw, 298px\" \/><\/figure>\n\n\n\n<h3 class=\"wp-block-heading\">COMMENT D\u00c9POSER UNE PLAINTE SI VOUS R\u00c9SIDEZ \u00c0 L'\u00c9TRANGER ?<\/h3>\n\n\n\n<p>PROFECO dispose d'un d\u00e9partement de conciliation pour les r\u00e9sidents \u00e0 l'\u00e9tranger (CARE), dont la fonction principale est de prot\u00e9ger les droits des consommateurs \u00e9trangers qui ont contract\u00e9 un bien, un produit ou un service avec un fournisseur domicili\u00e9 dans la R\u00e9publique mexicaine, de sorte qu'il est n\u00e9cessaire d'envoyer la documentation (facture, ticket et\/ou relev\u00e9 de compte) avec laquelle vous prouvez la relation commerciale avec le fournisseur et une pi\u00e8ce d'identit\u00e9 officielle (passeport) au compte de courrier \u00e9lectronique : extranjeros@profeco. gob.mx, afin que ladite unit\u00e9 administrative soit en mesure d'analyser son d\u00e9saccord et de d\u00e9terminer si sa r\u00e9clamation est appropri\u00e9e ; dans l'e-mail, vous devez sp\u00e9cifier les informations suivantes :<\/p>\n\n\n\n<p>1. Nom, adresse, num\u00e9ro de t\u00e9l\u00e9phone et adresse \u00e9lectronique. <br>2. Nom et adresse du prestataire ou du fournisseur de services, tels qu'ils figurent sur le bon ou sur le re\u00e7u d\u00e9livr\u00e9. <br>3. Description de la raison de votre r\u00e9clamation, y compris le bien ou le service que vous r\u00e9clamez, en indiquant clairement et bri\u00e8vement les \u00e9v\u00e9nements qui se sont produits, la date de l'achat ou du contrat, le prix total du bien ou du service et le montant r\u00e9clam\u00e9.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">QU'EST-CE QU'UNE MULTIPROPRI\u00c9T\u00c9 ?<\/h3>\n\n\n\n<p>Il consiste \u00e0 mettre \u00e0 la disposition d'une personne ou d'un groupe de personnes l'usage, la jouissance et d'autres droits convenus sur un bien ou une partie de bien, dans une unit\u00e9 variable au sein d'une cat\u00e9gorie sp\u00e9cifique, pour des p\u00e9riodes pr\u00e9alablement convenues, moyennant le paiement d'un montant, sans transmission de la propri\u00e9t\u00e9 dans le cas d'un bien immobilier, sur la base de l'article 64 de la loi f\u00e9d\u00e9rale sur la protection des consommateurs \"Ley Federal de Protecci\u00f3n al Consumidor\".<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">COMMENT SE FAIT L'ACQUISITION D'UN DROIT D'UTILISATION \u00c0 TEMPS PARTIEL DE BIENS IMMOBILIERS ?<\/h3>\n\n\n\n<p>Ils peuvent \u00eatre achet\u00e9s pour des semaines, ce que l'on appelle des intervalles ou des propri\u00e9t\u00e9s de vacances ; ce sont les types d'occupation les plus courants : <\/p>\n\n\n\n<p>1. Semaine et unit\u00e9 fixe : L'acheteur re\u00e7oit et peut utiliser un condominium sp\u00e9cifique, pendant une certaine semaine, chaque ann\u00e9e, tout en ayant la possibilit\u00e9 de profiter d'une semaine de vacances dans la destination choisie. <\/p>\n\n\n\n<p>2. Droit d'utilisation : La propri\u00e9t\u00e9 du d\u00e9veloppement est maintenue par le fournisseur. L'acheteur obtient le droit de l'utiliser pendant un certain nombre d'ann\u00e9es et, \u00e0 la fin de la p\u00e9riode, les droits reviennent au fournisseur. <\/p>\n\n\n\n<p>3. Clubs de vacances ou programme de points de r\u00e9compense : Les membres du club ach\u00e8tent des points, qui sont utilis\u00e9s comme monnaie pour acc\u00e9der \u00e0 diff\u00e9rentes tailles de chambres, saisons ou nombres de jours dans les diff\u00e9rents d\u00e9veloppements affili\u00e9s au fournisseur ou au fournisseur interm\u00e9diaire. 4.
