{"id":3166,"date":"2021-08-20T16:46:32","date_gmt":"2021-08-20T22:46:32","guid":{"rendered":"https:\/\/mexpatrealtors.com\/?p=3166"},"modified":"2023-04-06T20:25:47","modified_gmt":"2023-04-07T02:25:47","slug":"a-message-from-the-commissioner-of-the-national-institute-of-migration","status":"publish","type":"post","link":"http:\/\/mexpatrealtors.com\/es\/a-message-from-the-commissioner-of-the-national-institute-of-migration\/","title":{"rendered":"A Message From the Commissioner of the National Institute of Migration"},"content":{"rendered":"<div class=\"inherit-container-width wp-block-group is-layout-constrained wp-block-group-is-layout-constrained\"><div class=\"wp-block-group__inner-container\">\n<p class=\"has-text-align-left\">This \u2018Procedures Guide\u2019, presented as an easy and quick read for its users, is\u00a0 a joint effort between the International Organization for Migration (IOM), the\u00a0 International Labor Organization (ILO) and the Mexican National Institute of\u00a0 Migration (INM); agencies whose priority is to share data about\u00a0migration procedures regarding employment to foreigners and Mexico-based employers.&nbsp;<\/p>\n\n\n\n<p class=\"has-text-align-left\">The guide\u2019s five sections detail the administrative procedures required for an\u00a0 orderly, safe and regulated migration, in agreement with the Mexican State\u2019s\u00a0 New Migration Policy 2018-2024. The first section concerns foreign individuals\u00a0 outside Mexico, on whose behalf employers request a visa by job offer to the INM.\u00a0 To give an idea of its importance, in the last six years, up to August 2019, there\u00a0 have been 253,443 requests for this kind of visa, concerning foreign individuals\u00a0 from 173 countries.&nbsp;<\/p>\n\n\n\n<p class=\"has-text-align-left\">The second section refers to foreigners with a regular migratory status as\u00a0 temporary residents \u2013visitors or students- without permission to perform\u00a0 remunerated activities that nonetheless need to work within Mexican territory,\u00a0 which requires a specific work permit from the INM. In the aforementioned\u00a0 period, there have been 18,367 applications for this permit made by foreign\u00a0 individuals from 132 countries.&nbsp;<\/p>\n\n\n\n<p class=\"has-text-align-left\">The third section focuses on employers: individuals and business legally\u00a0 established in our country that need to hire foreign labor. This requires a\u00a0 Certificate of Registration of the Employer (CIE) from the INM, which enables\u00a0 them to issue job offers. In the aforementioned period, there have been 147,878\u00a0 requests to acquire or update the CIE, which was granted to 57 012 employers.&nbsp;<\/p>\n\n\n\n<p class=\"has-text-align-left\">The fourth section regards the migration procedure implemented in our\u00a0 country\u2019s Southern Border, through the Visiting Border Worker Cards (TVTF),\u00a0 allowing Guatemala and Belize nationals to work in the Campeche, Chiapas,\u00a0 Tabasco and Quintana Roo states. 96,292 TVTFs have been issued in the last\u00a0 eighty months, which encourages temporary labor and regional development.&nbsp;<\/p>\n\n\n\n<p class=\"has-text-align-left\">The last section addresses the obligation of temporary and permanent foreign\u00a0 residents to inform the INM on any changes to their marital state, name,\u00a0 nationality, address or workplace. There have been 108,688 application for\u00a0 workplace changes from 74 680 foreign individuals, which shows the labor\u00a0 mobility they have enjoyed in our country.&nbsp;<\/p>\n\n\n\n<p class=\"has-text-align-left\">Lastly, we hope this Guide transcends its written form and becomes a practical\u00a0 tool for every reader. Keep in mind this is a handy information source for the\u00a0 requirements of any new migration procedure you need to bring to the INM.&nbsp;<\/p>\n\n\n\n<p class=\"has-text-align-left\"><strong>INTRODUCTION&nbsp;<\/strong><\/p>\n\n\n\n<p class=\"has-text-align-left\">This guide\u2019s main <strong>objective <\/strong>is to provide information about the\u00a0 requirements and procedures applicable to foreigners of any\u00a0 nationality who wish to perform remunerated activities in Mexico.\u00a0 The guide is addressed to foreigners with a regular migratory\u00a0 status in Mexico and to those outside the Mexican territory.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"has-text-align-left\">It also intends to give information and guidelines to private employers,\u00a0 -legally established individuals and businesses \u2013 that wish to obtain\u00a0 the Certificate of Registration of the Employer (CIE) issued by the\u00a0 National Institute of Migration (INM), which allows them to hire foreign\u00a0 workforce as required.&nbsp;<\/p>\n\n\n\n<p class=\"has-text-align-left\">The Guide is divided in <strong>five sections<\/strong>, addressing the different\u00a0 procedures to apply for resident or visitor visas with permission to\u00a0 perform remunerated activities, as well as the requirements for\u00a0 employers seeking to hire foreign labor.&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Foreign individuals located outside Mexican\u00a0 territory.&nbsp;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Foreign residents with a regular migratory status\u00a0 without permission to perform remunerated\u00a0 activities.&nbsp;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Individuals and businesses legally established in\u00a0 Mexican territory.&nbsp;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><sup>Other Procedures (Visiting Border Worker\u2019s Card <\/sup>TVTF).&nbsp;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Obligations of foreign individuals residing in\u00a0 Mexico.&nbsp;<\/li>\n<\/ul>\n\n\n\n<p class=\"has-text-align-left\">The above stands in accordance to the migration policy enacted by\u00a0 the Mexican State, intended to encourage an orderly, regulated and\u00a0 safe international migration, as established in the Global Compact for\u00a0 Migration, as well as the principles stated in article 2 of the Migration\u00a0 Law, especially regarding the following issues:&nbsp;<\/p>\n\n\n\n<p class=\"has-text-align-left\">To encourage international migration while safeguarding order\u00a0 and security;&nbsp;<\/p>\n\n\n\n<p class=\"has-text-align-left\">Labor market complementarities between participating\u00a0 countries, so as to adequately manage labor migration according\u00a0 to the nation\u2019s needs;&nbsp;<\/p>\n\n\n\n<p class=\"has-text-align-left\">National-foreigner equity, as indicated in the Mexican\u00a0 Constitution, especially as regards individual rights for both\u00a0 Mexican nationals and foreign individuals, and&nbsp;<\/p>\n\n\n\n<p class=\"has-text-align-left\">Unfailing respect for the human rights of migrants, local or\u00a0 foreign, regardless of their origin, nationality, gender, ethnicity,\u00a0 age or migration status, with a special focus on vulnerable\u00a0 groups such as minors, women, indigenous peoples, teenagers\u00a0 and senior citizens, as well as crime victims.&nbsp;<\/p>\n\n\n\n<p class=\"has-text-align-left\"><strong>IMPORTANT:<\/strong><\/p>\n\n\n\n<p class=\"has-text-align-left\">The migration status conditions that allow performing remunerated\u00a0 activities are as follows:&nbsp;<\/p>\n\n\n\n<p><strong>\u2022 Temporary resident, <\/strong>whose card expressly states the owner,\u00a0 enjoys a working permit.&nbsp;<\/p>\n\n\n\n<p><strong>\u2022Temporary student resident, <\/strong>only as long as the work performed\u00a0 relates to their undergraduate, postgraduate or research studies:\u00a0 the migratory permit will include a legend to this effect.&nbsp;&nbsp;<\/p>\n\n\n\n<p><strong>\u2022Visitor with permission to perform remunerated activities, <\/strong>for\u00a0 stays of 180 days or less&nbsp;<\/p>\n\n\n\n<p><strong>\u2022Visitors for humanitarian reasons, <\/strong>visiting border workers and\u00a0 permanent residents are implicitly given a job permit, even if their\u00a0 migration papers don\u2019t clearly state as such. <\/p>\n\n\n\n<p class=\"has-text-align-center\"><strong>A.&nbsp;<\/strong> <strong>FOREIGN\u00a0INDIVIDUALS\u00a0OUTSIDE MEXICAN\u00a0TERRITORY\u00a0PROCEDURE FOR A VISA BY JOB OFFER:\u00a0(APPLYING TO BECOME A TEMPORARY RESIDENT\u00a0OR VISITOR WITH PERMISSION TO PERFORM\u00a0REMUNERATED ACTIVITIES<\/strong><\/p>\n\n\n\n<p class=\"has-text-align-left\">This type of visa applies when you live outside Mexico and the employer\u00a0 (be it an individual or business) offers you a job in our national territory.\u00a0 Should the job offer exceed 180 days, you must apply for a Temporary\u00a0 Resident visa. If the job offer is to work for less than 180 days, you require\u00a0 a visitor\u2019s permit to perform remunerated activities.&nbsp;<\/p>\n\n\n\n<p class=\"has-text-align-left\"><strong>Please bear in mind:&nbsp;<\/strong><\/p>\n\n\n\n<p class=\"has-text-align-left\">The employer will have to apply for a visa by job offer before\u00a0 any of the INM offices in Mexico.&nbsp;<\/p>\n\n\n\n<p class=\"has-text-align-left\">The employer must inform you that the INM issued a letter\u00a0 authorizing the consular interview to be carried out, so you\u00a0 must go to the Consular Representation of Mexico with\u00a0 said document to schedule an appointment to conduct the\u00a0 interview. You can also apply online the Mexitel website.&nbsp;<\/p>\n\n\n\n<p class=\"has-text-align-left\">If the consular interview is satisfactory, the immigration\u00a0 authority will issue the visa within the next 10 business days\u00a0 from the day the interview was held.&nbsp;<\/p>\n\n\n\n<p class=\"has-text-align-left\"><strong>TO APPLY FOR A VISA AS A TEMPORARY RESIDENT OR VISITOR\u00a0 WITH PERMISSION TO PERFORM REMUNERATED ACTIVITIES\u00a0 IN MEXICO, YOU MUST COMPLY WITH THE FOLLOWING\u00a0 PROCEDURE:&nbsp;<\/strong><\/p>\n\n\n\n<p class=\"has-text-align-left\">During your consular interview you should\u00a0 deliver the following:&nbsp;<\/p>\n\n\n\n<p class=\"has-text-align-left\"><strong>A visa application form for the consular office, which you\u00a0 can find in the Secretar\u00eda de Relaciones Exteriores (SRE)\u00a0 webpage, or in the consular offices themselves. A photocopy of the authorization letter from INM. A valid, current passport or travel ID, with a legible copy\u00a0 attached.&nbsp;<\/strong><\/p>\n\n\n\n<p class=\"has-text-align-left\"><strong>Any information requested during the interview, such as\u00a0 personal data, reason to travel and any additional particulars\u00a0 as required.&nbsp;<\/strong><\/p>\n\n\n\n<p class=\"has-text-align-left\"><strong>A recent, full-face, passport sized color photo, without\u00a0 glasses, on a white background.&nbsp;<\/strong><\/p>\n\n\n\n<p class=\"has-text-align-left\"><strong>Payment of visa emission rights.&nbsp;<\/strong><strong><\/strong><\/p>\n\n\n\n<p class=\"has-text-align-left\"><strong>IMPORTANT\u00a0INFORMATION:<\/strong><\/p>\n\n\n\n<p class=\"has-text-align-left\">The visa application format is available on the SRE website <strong>(https:\/\/consulmex.sre.gob.mx\/montreal\/images\/pdf\/ documentation\/Request_visa_ESP. Pdf).&nbsp;<\/strong><\/p>\n\n\n\n<p class=\"has-text-align-left\">The authorization letter of the <strong>INM <\/strong>with which you must go to a\u00a0 Consular Representation of Mexico to schedule an appointment\u00a0 to conduct the interview is valid for <strong>30 business days.&nbsp;<\/strong><\/p>\n\n\n\n<p class=\"has-text-align-left\">Once requested, the temporary resident visa or visitor\u2019s permit\u00a0 to perform remunerated activities are valid for 180 days from&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"has-text-align-left\">the day after the employer is notified of the authorization for a\u00a0 consular interview.&nbsp;<\/p>\n\n\n\n<p class=\"has-text-align-left\">The consular interview may take place in the <strong>Mexican Consular\u00a0 Offices of your country of residence, <\/strong>and you must deliver the\u00a0 migration papers validating your legal residence in said country,\u00a0 plus a copy thereof.&nbsp;<\/p>\n\n\n\n<p class=\"has-text-align-left\"><strong>PROCEDURE TO OBTAIN A MULTIPLE\u00a0IMMIGRATION FORM FOR EXCHANGE&nbsp;<\/strong><\/p>\n\n\n\n<p class=\"has-text-align-left\">Once you obtain the temporary residence visa and travel to Mexico,\u00a0 when you enter the country migration authorities shall give you a\u00a0 Multiple Migration Form (FMM), marked for exchange and valid for 30\u00a0 calendar days. Within this time, you must show up at the Application\u00a0 Services Office closest to your address, to exchange the FMM for a\u00a0 temporary residence card and work permit to validate your regular stay\u00a0 in Mexican territory.&nbsp;<\/p>\n\n\n\n<p class=\"has-text-align-left\">The INM has 32 Offices across the nation, which manage 126 Application\u00a0 Services Offices, where you may file for your Multiple Immigration\u00a0 Form for Exchange.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"has-text-align-left\"><strong>https:\/\/www.gob.mx\/inm\/es\/acciones-y-programas\/horario-y oficinas-del-inm&nbsp;<\/strong><\/p>\n\n\n\n<p class=\"has-text-align-left\">Allow <strong>15 business <\/strong>days response time to obtain your&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"has-text-align-left\">temporary resident card.<\/p>\n\n\n\n<p class=\"has-text-align-left\"><strong>YOU MUST FULFIL THE FOLLOWING\u00a0REQUIREMENTS:&nbsp;<\/strong><\/p>\n\n\n\n<p><strong>1. <\/strong>Present your valid passport or travel ID and a copy thereof, plus\u00a0 the visa issued by the Mexican Consulate.&nbsp;<\/p>\n\n\n\n<p><strong>2. <\/strong>The valid FMM you received upon arrival to Mexico.&nbsp;<\/p>\n\n\n\n<p><strong>3. <\/strong>The basic form, filled correctly.&nbsp;<\/p>\n\n\n\n<p><strong>4. <\/strong>Receipt of due payment.&nbsp;<\/p>\n\n\n\n<p><strong>5. <\/strong>Three 1R pictures, two facing front and one of your right\u00a0 profile, on a white background, with visible brow and ears, with\u00a0 no earrings or glasses.&nbsp;<\/p>\n\n\n\n<p class=\"has-text-align-left\"><strong>PLEASE BEAR<\/strong> <strong>IN MIND<\/strong><\/p>\n\n\n\n<p class=\"has-text-align-left\"><strong>Instant photos will not be accepted.&nbsp;<\/strong><\/p>\n\n\n\n<p class=\"has-text-align-left\">You must fill and print the application form, available at the\u00a0 following web address:&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"has-text-align-left\"><a href=\"https:\/\/www.inm.gob.mx\/tramites\/publico\/estancia.html\">https:\/\/www.inm.gob.mx\/tramites\/publico\/estancia.html<\/a><\/p>\n\n\n\n<p class=\"has-text-align-left\"><strong>What do you wish to do? <\/strong>Exchange or replace migration papers <strong>Specify: <\/strong>Exchange FMM for a visitor or residence card.\u00a0<\/p>\n\n\n\n<p class=\"has-text-align-left\"><strong>You should fill, print and present the basic form, also available\u00a0 at the INM webpage by selecting the arrow located in the\u00a0 Downloads section:&nbsp;<\/strong><\/p>\n\n\n\n<p class=\"has-text-align-left\"><a href=\"https:\/\/www.gob.mx\/inm\/documentos\/informacion-formato-basico\">https:\/\/www.gob.mx\/inm\/documentos\/informacion-formato-basico<\/a><\/p>\n\n\n\n<p class=\"has-text-align-left\">You will provide your fingerprints, pictures and signature in\u00a0 the presence of the <strong>migration authority <\/strong>that will supply the\u00a0 corresponding card.&nbsp;<\/p>\n\n\n\n<p class=\"has-text-align-left\"><strong>If you are the holder of a visitor\u2019s visa with permission to\u00a0 perform remunerated activities, <\/strong>you may remain in Mexico\u00a0 for up to 180 days without needing to perform the exchange\u00a0 procedure. The paper to validate your stay in Mexico will be the\u00a0 FMM given at your arrival to the country.&nbsp;<\/p>\n\n\n\n<p class=\"has-text-align-left\"><\/p>\n\n\n\n<p class=\"has-text-align-left\"><strong>B.\u00a0FOREIGN RESIDENTS\u00a0WITH A REGULAR\u00a0MIGRATORY STATUS\u00a0WITHOUT PERMISSION TO\u00a0PERFORM REMUNERATED\u00a0ACTIVITIES<\/strong> <strong>PROCEDURE TO OBTAIN<\/strong> <strong>A JOB PERMIT&nbsp;<\/strong><\/p>\n\n\n\n<p class=\"has-text-align-left\">If you currently reside in Mexico and own valid migration papers for\u00a0 your stay in Mexico as a temporary resident or temporary student, you\u00a0 can apply for a job permit at any of the INM Representative Offices\u00a0 across the country.&nbsp;<\/p>\n\n\n\n<p class=\"has-text-align-left\">This procedure should be resolved within 20 business days after your\u00a0 application.&nbsp;<\/p>\n\n\n\n<p class=\"has-text-align-left\"><strong>TO THIS END, PLEASE <\/strong>Workplace.&nbsp;<\/p>\n\n\n\n<p><strong>\u2022 <\/strong>Data from the Certificate of Registration of the Employer\u00a0 (CIE).&nbsp;<\/p>\n\n\n\n<p class=\"has-text-align-left\">Should you need to engage in <strong>independent activities, <\/strong>you must\u00a0 provide a letter under oath stating the job you will perform and where\u00a0 it will take place, attaching proof of enrollment in the Federal Taxpayers\u00a0 Registry (RFC).&nbsp;<\/p>\n\n\n\n<p class=\"has-text-align-left\">If you enjoy a <strong>Temporary Student Residence, <\/strong>besides requirements 1, 2 and 3, you must deliver an acceptance letter from your academic\u00a0 institution, explicitly stating it has no reservations about you performing\u00a0 remunerated activities.&nbsp;<\/p>\n\n\n\n<p class=\"has-text-align-left\"><strong>BEFORE SHOWING UP\u00a0AT INM OFFICES,<\/strong> <strong>PLEASE BEAR IN MIND:<\/strong><\/p>\n\n\n\n<p class=\"has-text-align-left\">As a <strong>temporary student resident, <\/strong>you may only obtain a work\u00a0 permit if you are an undergraduate, graduate, postgraduate or\u00a0 research student, and only if your job pertains strictly to your\u00a0 area of study.&nbsp;<\/p>\n\n\n\n<p class=\"has-text-align-left\">Should you need to deliver your application through a proxy,\u00a0 they will have to provide a power of attorney along with their\u00a0 valid ID.&nbsp;<\/p>\n\n\n\n<p class=\"has-text-align-left\">The INM may perform confirmation calls to verify the job offer\u00a0 and your employer\u2019s existence.&nbsp;<\/p>\n\n\n\n<p class=\"has-text-align-left\">Migration authorities may emit either of these resolutions:&nbsp;<\/p>\n\n\n\n<p class=\"has-text-align-left\"><strong>Positive: <\/strong>You will be given new migration papers stating\u00a0 you have a work permit, which will require you to provide a\u00a0 duly filled basic form after receiving your card.&nbsp;<\/p>\n\n\n\n<p class=\"has-text-align-left\"><strong>Negative: <\/strong>You will be given a resolution, duly founded and\u00a0 explained, returning your resident card if still valid, so you\u00a0 can retain your previous resident status.&nbsp;<\/p>\n\n\n\n<p class=\"has-text-align-left\"><strong>PROCEDURE TO EXCHANGE A TEMPORARY STUDENT\u00a0STATUS TO TEMPORARY RESIDENT, SO AS TO ENGAGE\u00a0IN REMUNERATED ACTIVITIES UNRELATED TO THE\u00a0STUDIES.&nbsp;<\/strong><\/p>\n\n\n\n<p class=\"has-text-align-left\">If you currently reside in Mexico and hold valid migration papers for your\u00a0 regular stay as a temporary student resident, and you wish to change\u00a0 to a temporary resident, at any time you may obtain a new card valid for\u00a0 1 to 3 years depending on the conditions of the job offer extended by a\u00a0 legally established individual or business that has obtained a Certificate\u00a0 of Registration of the Employer (CIE) by the INM.&nbsp;<\/p>\n\n\n\n<p class=\"has-text-align-left\">This procedure should be completed within 20 business days after\u00a0 receiving your application.&nbsp;<\/p>\n\n\n\n<p class=\"has-text-align-left\"><strong>TO THIS END, PLEASE PROVIDE THE FOLLOWING DOCUMENTS:&nbsp;<\/strong><\/p>\n\n\n\n<p><strong>1. <\/strong>Valid passport or travel ID and a copy thereof.&nbsp;<\/p>\n\n\n\n<p><strong>2. <\/strong>Receipt of due payment for the assessment of your status change\u00a0 application.&nbsp;<\/p>\n\n\n\n<p><strong>3. <\/strong>Valid temporary student card.&nbsp;<\/p>\n\n\n\n<p>You must prove the assumption of a job offer by providing the following:&nbsp;<\/p>\n\n\n\n<p><strong>a. <\/strong>The job offer in letterhead paper, provided by a legally established\u00a0 individual or business, formally established in Mexican territory,\u00a0 stating:&nbsp;<\/p>\n\n\n\n<p><strong>\u2022 <\/strong>Job description.&nbsp;<\/p>\n\n\n\n<p><strong>\u2022 <\/strong>Period of employment.&nbsp;<\/p>\n\n\n\n<p><strong>\u2022 <\/strong>Wages.&nbsp;<\/p>\n\n\n\n<p><strong>\u2022 <\/strong>Workplace.&nbsp;<\/p>\n\n\n\n<p><strong>\u2022 <\/strong>Data of the CIE issued by the INM.&nbsp;<\/p>\n\n\n\n<p class=\"has-text-align-left\"><strong>IMPORTANT\u00a0INFORMATION:<\/strong><\/p>\n\n\n\n<p class=\"has-text-align-left\">Should your application be given a positive verdict, you must\u00a0 provide the
